The automatic stay is in affect the moment bankruptcy was filed. I have 5 outstanding summons with the Sheriff. How to properly handle them? Should I just let them lie there, or should I pick them all up and respond to the summons by asking the court to honor the stay and dismiss the complaint.
Hi Senorita,
If you're in bankruptcy filing, then your creditors cannot send you summons or initiate any kind of legal actions against you. If they have done this, then you should immediately inform your bankruptcy attorney about it and ask him to take the required action.
Thanks,
Jerry

Hi Senorita,
I agree with what Jerry has said. As you have received the summons after your bankruptcy filing when the automatic stay is in vogue, it will be better if you could contact the attorney and take his opinion in order to know whether or not you should reply to those summons.
Thanks
