We surrendered our house to the bank in 2007. He filed BK13, I filed BK7. Both were discharged inclusive of the Mortgages on the house. In 2009 we recieved a 1099 on the house for the Mtg. Almost 6 years later no one having bought the house, the foreclosure being postponed for what ever reason, we don't know why - we are unable to purchase a home because our name is still on the deed. What can we do, are we at their mercy until the house sells? We pay no taxes on the property no bills, nothing at all. This just came up because we are trying to purchase a home. We are looking at an fha with 22% at 15 years. Can anyone shed some light on this. Is it a lost cause for us?
Hi Siciliana,

You will have somehow convince the lender to sell off the property ASAP. Unless the property is sold off, it will be difficult for you to buy another property.

Welcome Siciliana,

I agree with what James has said. You should make sure that you sell off the property quickly. Unless that is done, things may be tough for you.

Make it a point to convice your lender so that you can sell off your property soon. Unless you sell off your present property, you won't be able to buy a new one.
