New Homebuyer Tax Credit

My name is not on the mortgage but is on the title for our home. I am going through a divorce and my soon-to-be ex will probably either sell the home or let it foreclose. We have been in the home less than 3 years and therefore are required to pay back the New Homebuyer Tax Credit we got from the IRS when we initially purchased the home. Since my name is not on the mortgage, am I liable to repay the tax credit?

If your name is not mentioned on the mortgage docs, then you're not liable for the mortgage payments. Thus, I don't think you will be liable for paying back the tax credit to the IRS.

I agree with Adonis. If your name is not mentioned on the mortgage docs at present, then you are not liable to pay the IRS.
