Who can put a lien on a house

We recently had an addition put on our house and have paid our contractor the full agreed contract price. However, he has not paid one of his contractors for the work done to our house. The third party has been to our house threatening to put a lien on our house if he does not get paid, Can he do this - our contract was not with him, and we have paid in full. Any advice welcomed - we are in Maryland. Thankyou
Hi jackiejess,

As you have not signed the contract with that contractor, he will not be able to place a lien on the property. You do not owe the money to him. As he is threatening you to place a lien, you can contact an attorney and take his opinion in this regard. He has no right to threaten you for the money.

Thank you for your answer. I kind of hoped this would be the case, it wouldn't make sense for just anyone to be able to put a lien on my property. Hopefully my contractor will pay up and this will all go away!

my family had rented a house and did not get our deposit back the contract had a 30 day return of deposit owner stated she would wire the money but never did can we put a lien on the house ?

Hi david,

In my opinion, you may be able to file a lien on the property but for that you need to file a lawsuit at the court. You should consult an attorney and then take the required steps.

I did not sign a contract with this contractor; he was unlicensed and no insurance. He was supposed to fix my front steps and rails for $3000 verbally agreed, he removed the step stones and railing and while removing he damages the bricks under it, and then he told me that he can not find these bricks and suggested to place a bricks with different color. I had to let him go after all the mess he made not trusting what other damage he may do. I hired someone else that unfortunately had no choice but to place a different brick color since the original bricks is discontinued a while ago. Now, the front of my house looks ugly. After one week, the contractor asked me for $500 just for removing the steps and railing, despite the damage he done, I offered $100, he refused and said he will place a lien on my house and will sue me for the full $3000 even if he did not do the job, can he do that and what shall I do?

As there is no written contract between you and the contractor, I don't think he would be able to sue you. However, it would be better if you contact an attorney and discuss your situation with him. He will help you in knowing what steps you need to take.

If there was not legal agreemnet then it may be difficult for him to prove anything

But when only two partiesare involved with no one else as the evidence some tiems the verbal agreement can be used

If you paid him with cheque and he enchased it then he has proof that you did some business with him/her

my husbands cousin drove a cousins truck and crushed in the front house of were we live, now the manager of the parkinlot were we lived says that if we dont py the amount of money to repair the house, she will put a lien to our house...can she do that? we own our house but we werent the ones driving the truck or the owners of the truck

As you were not driving the truck, I don't think the manager of the parking lot will be able to place a lien on your house. Moreover, in order to place a lien on the property, she will have to get a judgment against you first.

There was a lien put on the house I reside in but other then that I have no legal connection. Nothing is in myv name. I realize I can tell the true owner and we can go through steps to take the lien off but I'm wondering if the true property owner can sue. Also I am a junior and the property owner is my father.

As your father is the property owner, you can definitely help him take steps to remove the lien from the property. Why do you think your father will sue you when you are helping him to clear off the lien?

I have a judgment from a domestic partnership dissolve here in California. The judgment gave me 30,000 cash and I sign off 3 properties. I quit deeded the Arizona property we owned together and now I want to put a lien on it to insure my judgment.

If you have a judgment against the concerned person, you will be able to place a lien on the property. You can contact an attorney and he will guide you in placing the lien.
