Time frame to move out

Posted on: 13th Nov, 2012 06:57 pm
I need some information and was hoping someone out there could help me out. We filed a bankruptcy and it was discharged in March, 2012. We did not reaffirm out house, but have continued making the payments and living there. However, we have decided to move and just walk away from he home since the mortgage was already discharged. I already have read that we will not be dinged again for walking away, but my question now is how long can we stay in the home until we have to move out of it? We filed in the State of Ohio, mortgage discharged in Jan 2012. We are currently 2-3 months behind on our payment. We have not heard anything as of yet on when the foreclosure process will begin. Does anyone out there have an approximate time frame of how long we can expect until we have to move out?
Hi Gordy,

The loan has been discharged in your bankruptcy filing. In such a situation, you're not personally liable for the loan. So, you can easily walk away from the property. It will be the lender's discretion as to when he will foreclose the property. Nevertheless, you can contact the lender and ask him to foreclose the property asap.

Hi Gordy!

Welcome to forums!

You may walk away from the property whenever you feel like. It will be better if you could move out faster so that you can search for a better place to live in.

Feel free to ask if you've further queries.
