My husband and I own a timeshare that we never use. Basically just paying maintenance fees for years. Trying to sell it and realized that we don't have the deed. I don't believe it was ever given to us when we paid off the loan. I went to the registrar of deeds where the deed is on file and it has the timeshare corp as the owner. In our purchase agreement it says that we will receive the deed promptly after the mortgage is paid, that was five years ago! Wondering if we can assume that agreement is void? Our name doesn't appear to be on anything legally at the point. Just wondering what my rights are and if we stop paying the yearly fees. Thanks

You should contact your timeshare company and ask them to give you the property deed as you've paid off the mortgage. You should be having the required documents which shows that you've paid off the loan. You can show them the documents and ask them to transfer the property to you.

I have tried to contact them many times, usually get the receptionist that knows nothing or get dumped into someone's voicemail and never a call back. I'm wondering what would happen if I don't pay the fees anymore can they come back to me? The tax bill is still in their name.

If the deed is not in your name, then the timeshare company will not be able to come after you if you stop the payments.
