Timeshare sucks

Hi,

I have timeshare with VI and I don't want it...I was taken in with the 'opportunity' to travel and the 'discounts' they gave me. They also told me that I would be a great candidate to use as a consultant for them-they would pay me to talk to people about their timeshare (which never happened). I was never notified that I could 'return' the timsehare within 7 days (I was only aware when I went through the paperwork 7 days too late). Right now, I have a primary residence in Washington and a timeshare that I never use and which is eating up my income. How do i get rid of this timeshare without it affecting my primary residence? That's what I am worried about...that this would cost me my home if i did something like stop paying the timeshare. The loan for the timeshare is through them and it's a secure loan and it's not paid off....I am drowing in bills and this is not something I can afford.....
The amount owed is about twelve thousand,a sum I don't want to consIder at this point of my life. The timeshares have bee paid for for many years,and we haven't used them for about seven years,that is why we haven't paid fees. The company won't entertain a quit sales,they have too much inventory.paying off this bill will only extend more years of debt if I can't unload the timeshares. I need creative ideas,please.

Statute of limitations can be used in defense against creditors/collection agencies.

Will a letter to the timeshare collection dept. Be enough ,or do you need a lawyer to get involved? Believe the timeshare is trying to get me to send any.

Hi Mariann,

You can send a letter to the collection department and inform them about the end of the SOL. I hope it will work. If they still contact you, then you can take the help of an attorney.

I don't quite comprehend how a statute of limitations would apply in a case where you've simply stopped making payments on what is an annual or a monthly bill. If you wish to pursue that angle, I suggest you obtain the counsel of a good attorney. Taking the average Joe's word for this is dangerous, after all.

The SOL for lawsuits to collect is five years in fla. A timeshare is a written contract. I'm hoping a letter of cease and desist will work, I'll let you know.

Our timeshare is long paid off, but the maintenance fees are now too much. The TS is located in St Maarten on the beach in week 01. Can I just walk away? Will it impact my credit score? How do I get rid of this? I can't seem to get anyone to take it.

Rather than walking away, you can sell off the timeshare to the timeshare company. This may help resolve your issue.
