took out a loan for a house for someone and they stoped pay

When I was younger, my dad, asked me to take out a home for his best friend, my dad past away and his best friend has not payid the house for 5 months and is ruining my credit, i want to evict him but he is on the tittle of the house with me , and im the one stuck with the loan, how do i get him off the tittle and off the property/

you cannot get him off the property title until he is ready to give up his share of the property. you cannot also take his name off the mortgage until you refinance the loan in your name. is selling the home a possibility? will he agree to sell off the home? since you are a legal owner of the property, you might even be able to force him to sell the house. consult an attorney to find out if is possible.

i agree that you need attorney assistance. you can seek court approval for a sale of the home under the circumstances...you can simply pick up where he left off and make payments on the existing loan until the debt is brought current. i hope you're aware that when you purchased this home, you were obligated to make payments.

that ought to be your first priority - to try to get the loan current so as to put off any foreclosure action. then you can try to force a sale with the assent of the court, and move on from there.
