Hi, I inherited my house, fixer upper, but free. I had rather significant unsecured credit card debt before I got the house. I was starting to have problems paying the real estate taxes and my credit cards. I filled chapter 13 but am being told the plan will not be confired due to I have to much in the way of assetts and my income is not enough to fund the plan. If the plan is rejected, can the unsecured credit cards place a lien against my house? The bankruptcy judge won't force me to sell the house to pay for the unsecured debt?

Hi Vera,
If your bankruptcy filing is dismissed, then the credit card company can file a lawsuit against you and place a lien on your property. If your Chapter 13 filing is accepted, then your property will not be sold. Rather, you will get a repayment plan to pay off the mortgage.

But I don't have a mortgage. the credit cards would place a lien against the house and only if I sell the house is when I would have to repay them right?
