Mortg Deed vs Warranty Deed

My sister has owned her home since 2002. It was in her name only. She did marry a few years later. When she refinanced the house they put her husband on the Warranty deed without her permission. She is on the Mortg deed and he is on the warranty deed. We are both confused. She is now contemplating a divorce and dosen't understand if he legally own's the home or not???

If your sister's husband is on the warranty deed, then it means that he is an owner of the property and has equal rights to it as your sister. On the other hand, as your sister is on the mortgage docs alone, it means that she is solely responsible for the loan payments.
