In August 2011 I was served notice of Lis Pendes in Florida by Lawyers representing CitiMortgage for property owned by my ex-husband. We were not married when he took out the loan nor was I involved with the transaction. I submitted evidence to the Clerk of Court as well as the attorney for the Plaintiff validating I was not party to my ex's legal issue with CitiMortgage. I contacted the Plaintiff's attorney who was less then helpful. Public records reflect two Lis Pendes; one with my first and last name and the other includes my middle initial. In Feb 2013 a "notice of dropping party" was filed, however to date the public record still reflects active Lis Pendes. I have made several calls without success to the Plaintiff's attorney to correct this matter. I received notice I was denied a car loan due to "derogatory public records or collections filed" on Equifax credit report. Given I had nothing to do with my ex's loan and we were legally divorced, filing the Lis Pendes against me wrongful? Also, now given it is adversely affecting my credit standing, do I have any legal recourse? Thank you!

If you were not on the property title or the mortgage and had nothing to do with the property, then, you should not be made a party to the Lis Pendens. It would be better if you could now get in touch with an attorney and sort out the matter.

I agree with Adonis. In order to get rid of this situation, it will be better if you could contact a real estate attorney.
