Wrongly foreclosed upon by IndyMac

Posted on: 09th Nov, 2010 10:51 am
Long story short, IndyMac has refused to fix an error that shows we are 3 months behind. This same error has happened since July 08, when we entered Indy Mac's modification.

It gets "fixed" then restarts. I can't take much more.

Just received another foreclosure notice in the mail, via certified mail. I am beside myself.

Indy Mac REFUSES to fix this "glitch" and I don't know what else to do. Hiring a lawyer right now it cost prohibitive.

I don't know how to make them fix this mistake. We have not missed a payment since July 08, nor have we been late.
Welcome to the club. I am beyond broke and NOT behind any payments at all, have receipts to prove it, and PNC insists I am behind and is planning to begin to foreclose on me next week. I do not know where to turn to....and I cannot believe this is happening. No lawyers I call will touch me.

It is beyond infuriating. I have all the documentation that we have paid, and that we are not past due in any way, shape or form. I have had to bring their lawyers my bank statements showing we are not behind. I have been to federal court to file papers to stave off the beginnings of the foreclosure process (this was in March).

I mean really, they cannot fix this error already? I am the OP, BTW.

Hi Guest,

I can understand your frustration. You should contact your lender and ask them to resolve the matter once and for all. You should ask the lender to take the needed steps asap regarding this matter.

Thanks

If any of you have entered into the trial modification HAMP program and you have completed your 3 trial payments, you need to call the credit reporting bureaus to confirm this but I believe you are reported late because the trial payment is not the full contractual payment. The lenders maybe reporting you behind even though technically your not. According to the guidelines in HAMP I believe the servicing lenders ARE Not suppose to report you late while you are on the trial loan modification. IF this does not apply to you, you can contact your lender, ask for a manager and raise holy hell. Try contacting the lenders credit reporting department if that doesn't work contact your local Congress persona and write a letter.

They took bail money but will not work with me. They did not even give me a chance to save my home. Indymac is the worst of all.
