i am 1/5 owner of this property...my deceased brother is 4/5 owner. how can I get my name off of this deed? I have just had open heart surgery...this situation is causing me to be very depressed. I am responsible person, and the propery taxes come to my house, and I pay them. I don't want to maintain this house...I want either get his name off of the property so I can sell it or turn it over to the county...I don't want to pay anymore property taxes. I am 75 years of age.
What type of estate was the property in? Who is the beneficiary of the deceased brother? If there are no other heirs, depending on the type of estate, you should be able to contact a title company and have them prepare the proper deed to remove the deceased. Then you are sole owner, and then you can sell, or gift the property away.

My mother's estate...which i had taken care of her for 12 years in my home...and my attorney felt that i should have the house. but my other sibling did not feel that way...that is why the judge went ahead and put all 5 names on the deed. in spite of the fact that i had a buyer for the house at 46,000.00. in 2003 that was a lot of money..but my siblings are like the my brother's decease children...sorry and don't care. no money was owed on my mother's house either. margarett l. thomas. again where does this leave me.

Hi Margarett,

You and your other siblings are the owners of the property. You won't be able to sell off the property unless all the co-owners of the property agree to it. You will have to convince them or buy them out if you wish to sell off the property.

Margarett have you consulted further with an attorney in this regard? At least at this time, you might be able to learn something that would be of benefit. You need to be able to present the court with information that would persuade them that it makes sense to undo what the previous judge did...but that's something, as I mentioned, to work out with the assistance of an attorney who is schooled in such an area.

I think you should donate your property to some charitable foundation so that all the taxes can be removed.
That just my guess and in don't know that will work or not.

I trust that you won't take that advice from the "player" as noted above, Margarett.

Clearly, "donating" the property won't accomplish what it is you wish to do.
