My exhusband signed a quitclaim deed after our divorce. The mortgage was only in his name and I kept it that way to avoid refinancing charges. I am now able to pay off the mortgage but am concerned that his name will be on the title rather than mine. I am unable to talk to the mortgage company since they will only speak to the "owner" (name on mortgage statements). When the title arrives, do I need to change the name to mine and how do I go about this?

I would like to advice you that,Quit claim house on your name & refinance the mortgage on your name & then you will be the owner of property as well as you must have to pay off to lender.

i believe i already answered this question in another thread. you will not receive "title" from the lender once the loan is paid. if you have already filed your quit claim deed with the proper authority, then you have title now. you'll receive a release of the mortgage that needs to get filed to show it paid on title. there's no need to refinance in order for you to become the sole owner...you already are the sole owner.
you can confirm your ownership by title search. till then do not pay any money.
what is that about, tim? spending money on a title search is fruitless - the lady already has in her possession a quit claim deed that grants her full ownership. if it's been filed, then title will appear in her name, solely.

Curious - what would happen if she did not pay the mortgage (NOT advising this - just hypothetically)?
Since she owns title to the property but never signed the mortgage hiow would the bank go about trying to foreclose?

George, i do not think that she has deed with her for review/ varification. that is why she is doubting on ownership.

there's the evidence of ownership, right there. vconor owns the home - there's no need to have a title search done to demonstrate that. the only issue regarding legal title is if the deed has or has not been recorded, and that's something vconor can do rectify, if needed, all by herself.

thank you so much, mr. akerley. i am paying off the balance this month before the arm readjusts in november. i guess i will just wait to see what i receive in the mail from the mortgage company and go from there. as i'm sure you can imagine, the mortgage company will not even talk to me since the mortgage is under my exhusbands name and social security number so it has been a bit frustrating!
