Can a quitclaim deed be transferred legaly from one person to another, and the mortgage remain in the grantors name allowing the grantee to legally apply for basic homestaed exemption in the state of Georgia?...My brother lives in the state of Virginia, owns his own houme in Virginia, but purchased a home for me (his sister) in the State of Georgia. He wants to quitclaim the deed to me until my credit score is high enough to purchase the home myself. Will I be able to claim Basic Homestead Excemption legally in the state of Georgia? It would lower the property taxes but I dont want to file for basic homestead exemption if it is not legal. I read the Georgia law which states that no transition shall be made in collusion with another for the purpose of obtaining a homestaed exemption contary to the law. I dont believe that we are breaking any laws but I want to be sure. Thanks

If you are the owner of the property and if it is your primary residence, then you would be able to claim the homestead exemptions. However, before taking any step, I would suggest you to contact an attorney who will let you know whether or not it would be considered as illegal.
