I have a home, and property that was given to me in my fathers will. My mother was to have a life estate to the house and land. She has to pay taxes, and insurance and take care of the house with upkeep and repairs. She feels that I should pay the taxes and insurance since the place is mine, she also has a dog and the dog does her business in my house. My mother is not keeping the house clean, and the smell is horrific. We haven't spoken in over a year. She has changed the locks, and she has no intention on cleaning the floors, she say's that she has looked in a cleaning service that I can hire when she dies to come in and take care of this problem. What can I do I feel that my hands are tied. My father would have never let her do this with the house. Can I get compensated for the destruction of my house while she is living. I have been taken out of her will. I will be left with nothing.
Hi whitley,
As your mother has a life estate, she will have the rights to stay in the property until death. After her death, you would become the sole owner of the property. I don't think you would be able to receive any compensation from your mother. However, your best option would be to contact an attorney and take his opinion in this regard.
Thanks
