Property Rights

A loan was taken out on some property in both married parties names & paid off. Since that time, they have been divorced over 37 years, only one of them has ever paid taxes on the property. A quickclaim was drawn up so the property could be turned over to their adult children before their death, this was refused by one of the parents. Sad to say one of the parents recently passed and willed the land to their children.


What rights does the divorced parent have to the property? What rights do their adult children have at this point?

It is really sad to know the situation but this is a common problem. As per my knowledge, if the property is a joint property then if one person dies then automatically his/her heirs will become the owner of the property even if there is no will. The best thing will be to consult with a good real estate attorney and check what legal rights do the person has on the property and do accordingly.
