my husbands house still has his ex-wife listed on the property/mortgage even though thier divorce decree states she has no claims to the house. if he chooses to do a quitclaim to remove her name from the morgage/property, will he have to refinance? if he chooses not to do the quitclaim and something should happen to him, would the house go to her since her name is still listed?
HI angelagutierrez,
Your husband should ask his ex-wife to sign a quitclaim deed and transfer the property to him. Then he can refinance the mortgage and remove her name from the mortgage deed. This will make your husband the sole owner of the property. If the ex-wife's name remains on the property deed, then she can claim the property after your husband's death.
