I Have a house that was foreclosed on in September I have a tenant in there and they won't let me get my washer and dryer and refrigerator. What rights do I have to get them? Also, I cashed the September rent check and the house went to trustee sale on 9/8 do I need to prorate the rent back? So far the bank has not notified her and she is still living there. She is taking me to small claims court in November stating I owe her the $1,500 deposit and $1,500 for September rent. I was told that it's the bank that refunds her deposit. Funny thing is that tomorrow is October 1st and she is not complaining about not paying rent.

Though your property was foreclosed, you'll have the rights to take away your personal belongings. You should contact your attorney and take his opinion in order to get back your personal items. As far as I can understand, you won't be liable for paying her the rent for the month of September.
