Name change necessary?

Posted on: 10th Dec, 2010 12:07 pm
My fiance and I got married 5 months ago. We bought a house 6 months prior to the marriage. The deed and the mortgage are in my name. We live in Houston. Is it necessary to change my name to my married name on the deed? If so how should I do this? Should I add my husband to the deed since TX is a community property state?

Heather - Houston, TX
Hi hward,

It will be better if you could change your existing name on the property deed to your married name. You will have to sign a quitclaim deed mentioning your maiden name as the grantor and married name as the grantee of the property. It will be your discretion whether or not you'll add your husband's name to the property deed.
