i have a property in my name and my mother, she passed away in 2008. but my brother lives in the property and has been paying the mortgage. how do i transfer the house to him without changing mortgage.

You can transfer your share of the property to your brother by signing a quitclaim deed. As far as your mother's share is concerned, he needs to file an affidavit of heirship at the county recorder's office and get the property transferred in his name. However, the lender will ask your brother to refinance the mortgage after the property transfer takes place.
