after may divorce proceeding my lawyer stated that a quit claim deed had been filed, and all i needed to do was finance mortgage into my name, after going to probate office to get a copy of deed, my mortgage company will not speak to me even though i provided all documents during divorce proceedings and after showing that a judge had awarded me the home, the probate office advise me there was no quit claim deed on file. what can i do.
are you already on the loan? or was the x the party on the loan? we you never on title? if all you need is to be added to title, then you need to have your x (the title owner) add you on title via quitclaim. then you would refinance the home in your name, and your x will have to sign a quitclaim at closing to remove himself from the loan. its unfortunate, because with a court order, it means nothing to the bank. who ever signed the note, is who is responsible.
