My father passed away suddenly without a will. He had a property that was in his and his Ex-wifes name but in the divorce papers it states that he would get the property. After calling her and asking if she could put it into my sister's and I's name. She is refusing. (We have been paying the property taxes on it for the passed few years)
What/ How should I go about this in order to get it taken care of?

Hi bogartkg,
You and your sister will be able to claim your father's share of the property. However, as far as his ex-wife's share is concerned, unless she signs the quitclaim deed, you won't be able to claim her share of the property. You should contact her and negotiate with her so that she transfers the property to you. If required, you can even buy her out by offering her a certain amount of money in lieu of the property transfer.
Thanks
