my wife holds title of the property in her name thru a quit claim deed signed by me. we want to change it to a bargain and sale deed in both names. can we use the bargain and sale deed? she is presently holding title.
Guest, if I'm correct (and I have no legal expertise), a bargain and sale deed will not uphold any warranties. Well, that's tantamount to a quit claim deed, which is also granted without warranties. Though it behooves you to discuss this with legal counsel, I don't know why you wouldn't be able to do what you wish.
