my father quitclaim deed the property that i have resided in since 1971, the quitclaim deed that my father did was to me as stated t.b joint tenant singled never married, before my father did this the two of us refinance the property shortly after my mother passed in 1998, the quitclaim deed was done in 1999, my brother has the same name as my father, my brother has been giving problem claiming that his name is also on the quitclaim deed but it's not next to my father's name is widowed meaning my father is a widowed, my father passed in 2004 i have remained in my home and have continued to pay the mortage and so did both my father and i before he passed, all the utilities bills are in my name including the property tax. my brother is in incarcerated which is where has been going for more than half his life. can my brother take me to court, would i have to sell my house and give it to my brother, what rights do i have, my brother tried to take me to court while he's incarcerated, but was unsuccessful with that, the court sent papers to me because my brother was not filling the papers out right and i was told by the court clerk that i did not have to acknowledge that.
Hi T.B.!
Welcome to forums!
It will be better if your could discuss your case with a real estate attorney who will guide you in this matter. I don't think your brother will be able to take you to court. I don't think your brother will be able to force you to sell off the property.
Feel free to ask if you've further queries.
