Life estate

My brother is in a nursing facility & I am his legal guardian. He is the sole name on the deed to the family home in Virginia, which our mother has a life estate. He was given the home in 2004 from our half-brother with the condition that she be allowed to reside in the home. Medicaid is saying he has to sell the home or he will lose his benefits. I cannot tell our 88 year old mother that we have to sell the home. Any help here?

As your brother is the owner of the property, Medicaid will ask him to sell off the property. This is something which you and your brother won't be able to avoid. You will have to somehow inform your mother regarding this.
