Quit claim

Posted on: 09th Sep, 2011 10:55 am
My father and mother were married for over sixty years. They were separated though not legally. He purchased property in his name only. He died recently and a quit claim appeared with the name of his girlfriend as his wife and an attorney's signature in his wife's place. The quit claim gave the property to the girlfriend using her maiden name. Is it a requirement that the spouse(legal) sign any quit claim?

It also appears that the signature is not my father's. He died intestate in Illinois. What does Illinois law require on a quit claim when a person is married?
I dont know your state law, but you can check with your local title company and they can clear the legal matters for you and let you know what is a requirement for community property in your state, if community property laws apply.
