wife passed away, need to take off deed

Posted on: 22nd Dec, 2011 08:51 pm
My wife recently passed away and we both own property in LA county. I'm not sure which form to use - Death of Joint Tenant or Surviving Spouse Succeeding to title to community property? She did not leave a will.
Hi lgutier,

You need to file an affidavit of heirship at the county recorder's office and get the property transferred in your name. You can contact a real estate attorney and he will be able to assist you in this matter.

Thanks

How was the title held on those properties? Were you both on title? Did you hold as right of survivorship?
