Posted on: 24th Jul, 2013 11:02 am
Hello, My husband grandmother passed away and did leave a will leaving him as the one to get the house which we are living in now, however everything is still in her name..mortage, insurance all except the the light bill which has always been in my husband's name.Alslo there is still a mortage on the house which my husband has always been the one to pay it. even before her death. We do have a copy of the death certificate from the funeral home, and a cpoy of her obituary. Im trying to find out what else do we need to get this quit claim and how?
Thanking You in Advance

Hi Sonya!

Welcome to forums!

As there is a will, your husband and you will have to probate it in order to get the property transferred in your name. You should get in touch with a real estate attorney and he will help you in probating the will.

Feel free to ask if you've further queries.

Welcome Sonya,

As the grandmother is deceased, quitclaim deed will not help your husband to get the property transferred in his name. He will have to take steps to probate the will.
