I was divorced in 2011. my ex hasn't paid a penny on our house since he left in 2009. He signed over the deed to me, but is still on the mortgage. I received a check today from my escrow account for over payment on taxes and insurance. (which I pay). when we were divorced, we didn't fight over property. I wasn't aware that his name would be on the check I got. I was told by the mortgage company that I need to have a court order to have his rights to the escrow removed. How do I do this and is it absolutely necessary to have an attorney? Remember..he has paid NOTHING towards this house since 2009. Also the check was sent after a reevaluation of THIS YEARS escrow payments.
