I am considering refinancing and most of the paperwork is done. me and my husband are separated about to divorce. He is willing to sign a quick deed. Will that be a good idea or not if we haven\'t had a divorce yet and I am requesting help (alimony) with payment from my husband in our divorce judgement?
Hi Januaryt,
Welcome to Mortgagefit forum.
If both of you mutually agree to it then there is no problem in going ahead with the title transfer. How getting the house before the final divorce judgment be affecting your alimony payments will be hard for any one to tell.
Your attorney will be able to tell if it is going to put any affect on your alimony payments. But as far as I know it should not make much of a difference.

you can get the ownership from your husband with a quit claim deed but alimony will be decided by the divorce court. whether alimony for making the mortgage payments is granted by the court or not will depend upon how much share of the assets each one of you get and your financial position after the divorce.

hi januaryt,
i think you can go ahead with the quitclaim. it will convey whatever interest your husband has in the property over to you. the title, being in our name after the quitclaim, you can refinance the loan in your name and carry on with the loan payments. i don't think your requesting alimony from your husband will in any way affect the transfer of property or the refinancing.
thanks.
