What kind of legal documents do I need to remove my soon to be ex wife from the mortgage? And where can I find them? She wants to sign off on it...I just dont know where to get the documents needed for the transfer.
you will need to talk to your lender. you will either a. get permission to assume the full responsibility for the mortgage. or b. refinance.
if you have to refinance you will need 2 additional things. you will need to choose the lender. and you will need to set it up with the lenders title company for her to quit claim the property at the closing of your refinance. so she will have to be there at least for that part of it.
this is not something you should or can do on your own. you at very minimum need an attorney.
