at the time of my divorce we had to sell the house and split the proceeds. i asked my brother to purchase the house. the deal was that i would fund the purchase if he could obtain the mortgage and then he would add my name to the deed. i gave him all the funds to complete the purchase. it has been almost 3 years now and he has made no attempt to add my name to the deed. can i add my name to the deed using the quit claim deed? if not, how can i add my name to the deed?

You will have to ask your brother to sign a quit claim deed and add your name to the property deed. Unless he does so, your name won't be added to the property deed.

It is true that until and unless your brother signs a quitclaim deed and add you to the property, you cannot do anything. If you have anything in writing that it was decided by both of you that you will fund the purchase and later your brother would add you in the property, then immediately consult with a good attorney with the proof and check if you can take legal action against your brother.
