scenario: my husband purchased the house before we were married. we are getting divorced and he wants me to have the house. (i owned a house in another state and after moving to texas he lost his job. i was the only income source and have been paying the mortgage, but let the house in another state foreclose.) he feels that i deserve the house -due to my foreclosure and guilt from his infidelity!, plus he can't afford to keep it. first, i need to know the best way to add my name to the deed? quitclaim or warranty. second in the divorce settlement does he give me the remaining interest in the house? i would like to refinance, but i can't because of the foreclosure. my brother is willing to help with this. can my husband add me and my brother on the deed - so that after the divorce is finalized my brother can refinance the house? or should i obtain the property 100% and quitclaim or warranty to my brother after the fact.

You can ask your husband to sign a quitclaim deed and transfer the property to you. This will make you the owner of the property. Once he transfers the property to you, then you can add your brother to the property by signing a new quitclaim deed. Once your brother is added to the deed, he will be able to refinance the mortgage.
