adding a name to a property using power of att.

i stay in a house that is owned by my first cousin, he recently contracted cancer and wants to put my name on the house. problem is that he lives in another state and his medical condition won't allow him to leave. my mother has power of att. of him and i was wondering if she could use it to put my name on the deed
Hi bobware,

It depends on what type of power of attorney she has. If it is clearly stated in the POA that your mother has the right to transfer ownership of property owned by your first cousin, she can do it. Otherwise, she cannot. I think you can get a quitclaim deed signed by him and have it notarized and recorded in the county clerks office where the property is located. The deed also has to comply with the laws of the state where the property is situated.
