'Hi, I bought an investment house 4 months ago and warranty deed only show my name because I was the one on the mortgage. Is it necessary to add my wife name on warranty deed? She feel more comfortable if it shows both of our names on it. I have heard that Texas is community property state. But we are not living in this house. And she claims that if something happen to me, she can have survivorship from joint names on warranty deed. Is it true? Is it necessary to add her name on warranty deed? What''s the difference with or without her name on it? Thanks

It is not mandatory for you to add your wife to the property deed. However, if you add your wife to the deed, it will give her ownership rights to the property. Unless her name is mentioned on the property deed, she won't be able to claim community interest in that property.

Thanks for your quick reply. How to add my wife as Co-owner or Joint Tenancy in Texas? Do I need to sign QuitClaim deed first, then add both of our names on General Warranty deed? Or don't need to do anything just protected by community property law as Joint tenancy? Thanks.

Hi DH,
You will have to sign a warranty deed in order to add your wife as the co-owner of the property. It's better to add your wife's name to the property in order for her to claim community property interest.
