Lorraine, have you been in Florida in the last 6 yrs. and was anyone living there when you visited? If you tell more on this issue like how she is claiming she has been living there and has maintained that property then we would be able to tell if she has the right to claim adverse possession rights over it.

Hi Lorraine,

Welcome to the forum.

It's all very strange Lorraine. I mean you're being sued for something in which you aren't involved at all. I really don't understand why they're after you – may be they aren't getting anyone out of the living heirs and that's why they're targeting you. It's better that you consult an attorney who deals with adverse possession issues and take his legal advice.

Hope this helps..

God bless you.

Hi Lorraine,

In Florida, if a person occupies and uses someone else's property for a period of 7 years continuously, then only can he claim his rights on the property by the law of adverse possession. So, I don't think the lady has the right to claim her possession and ownership on the property.

I shall agree with Samantha here because I feel this is something for which you need to talk to an attorney asap. And, in case, you wish to get an overview of Adverse Possession in general, take a look at the previous discussions that the community had on this topic.

good luck :)
