Question about adverse possession

Posted on: 10th Jul, 2010 03:39 pm
My wifes family has owned a cabin on lake cypress since 1970 which sits on state land. The cabin is built on 4 foot high stilts because sometimes the lake water rises under the cabin. The state is now knocking on our door and stating that they have no proof we can be where we are. We do not pay taxes and do have power running to the cabin. Well water and septic. What are our options?
Hi RdH
"We do not pay taxes and do have power running to the cabin."

If you are not paying property taxes then it seems to be little difficult to convey them that you (your wife's family) are the owner of the land.

I think you might have got electricity connection under a tenant quota. You need to check out the status with electricity department.

keep in touch...........

I think he's stating that perhaps they own the cabin but not the land it sits on...
You should really consult a qualified real estate attorney about legal issues like this.

I tend to side the previous poster... If you're not paying property taxes, you probably don't have a deed or any other proof that you own the land the cabin sits on. The question then becomes your ability to claim it because you've been there since 1970. Again, since this is on state property, I'm guessing that your rights are extremely limited and even then subject to imminent domain or other seizure.
