Affidavit of Heirship as proof of ownership

We have an attorney that we hired to handle Probate of my Mother's Will. Since all there are no outstanding debts, our attorney suggested that we file and Affidavit of Heirship and we would avoid the extra expense of having to go through the court system. He said the only drawback is that some Title companies don't like this Affidavit of Heirship in the place of a Deed. We would save about $750.00 and avoid going to court by filing this document. Any thought or suggestions? Thank you for any comments you may offer.

If there is a will, then you will have to probate it. The affidavit of heirship will only come into question if there is no will left back by the deceased person.
