Transfer of property to avoid it going to state

Posted on: 14th Jan, 2013 05:36 pm
My mother in law has a piece of land which my husband pays taxes on, can she do a quit claim to him and when she dies will the land go to him instead of the state. He also has brothers and sisters would they have anything to do with getting the land?
Hi Cat!

Welcome to forums!

If your mother-in-law signs a quitclaim deed and transfers the property to your husband, then he will become the owner of the property. The state cannot claim the property. If the property is solely transferred to him, then his brothers and sisters won't be able to do anything.

Feel free to ask if you've further queries.

if your mother in law transfers the property in your husband's name through a quit claim deed, then your husband will be the sole owner of the property. however, if your mother in law does not do so then all her heirs will have equal rights in the property after her death.
