My brother wants to be the sole caregiver for my mom when she runs out of money and goes on in-home care Medicaid. Since he has lived there (at her house) for more than 5 years, and so that Medicaid does not take her house, my brother wants me to transfer the deed to the house over to him to avoid Medicaid from claiming money from the sale of her house. I don't see the need to do this. Is there any reason for this? We are both POA's and want equal shares in the future sale of her house.
Hi foundgrace,
I don't think you need to transfer your share of interest in the property to your brother will in any way help to avoid Medicaid from claiming money from the sale of the house. If you quitclaim your property-interest to your brother, it will be difficult for you to get your share of property, unless he signs it back to you.
