my mother wants to transfer the deed to her property to her children. the potential issue is that she owes back taxes (county), can we still quit claim deed to the children without paying the taxes right now? she is making payments....
also how does her husbands interest fit in there....since this is a community property state which takes preference? she is trying to leave it solely to us children.

Your mother can transfer the property in your names though she owes back taxes on that property. You and your siblings can pay off the back taxes after the property transfer. If it's a community property, then his husband will also have ownership rights to that property and he should also sign the deed to transfer the property to you.
