Iam the only legal person in my dads will. My dad had a stroke that blinded him, and his mind was messed up. I have been living in NC. for 11 years. when dad had his stroke, after my only sibling brother passsed in his sleep in 2002 , 3 week after his death my dad had the stroke. my sister in law(brothers widowe) lived next door and called me about dad.
I was recovering from a hip replacement,at the time.so told her to just get power of atty to contact with doctors and keep me informed, that was all she was to do.dad was now in nursing home in az.
3 months before he died she did a quick deed on his house, and sold it to her future husband ,for $3,000 and had him take over the morage. she also took a gun collection of dads worth 60,000 and all house hold goods.
she of course didn't tell me what she done.
my daughter had to go to the furnel, for me.
dad died in 2003. how could, she have stolen all that left to me in the will.?there was no insurance policey she told me. so she had to forge also his name,
I had told her to just shut the house up and don't mess with it
his retirement paid for the morage payments while he was in the nursing home.she stold every thing. can i take her to court to regaine, what is rightfully mine :?:

If your sister in law had a power of attorney on your father's behalf, then she could have used it to transfer the property in her name. As a quit claim deed is filed prior to the death of the grantor and comes into effect during the life time of the grantor, it would be given more importance than the will as it comes into effect after the grantor's death.
