buying a home which is transfered to wife from husband

Posted on: 08th Dec, 2009 08:44 am
Hi,

I gone thru my agent and signed a contract to buy a home on dec 2'nd.
The contract signed by wife and her name is showing in county office.
In countu office a transfer is also recorded in 2008 from husband and wife to wife. Now we signed the contract thru wife.

Now we got a call from her broker saying that she talked to his husband and has some issue. It looks like they are saying they need his permission too. He is showing some financial interest. My agent said they will tell us in couple of days what is it.

I think when he transfered in 2008 and county also has a record on wife name. wife can sell it. I know from my agent that she has some loan too.

I am in the process and gave notice to my appartment. I am not sure that i will get this appartment again. means i have to look some other appartment and plan to move. Also paid 450$ non refundable amt for apparaisal to bank of america. not sure they refund it. sold some shares and requested 401K loan. I mean i involved in process and has to pay some amt for the mistakes.

i am not sure also is it played by seller if they get another good offer or not want to sell. what i should i do now. where i can get this deed info and their property lean info.

they file divorse and the case is in court.

pl suggest what to do.

thanks

if the wife owns it, it ought to be hers to sell. the husband, having relinquished his interest in the home, ought not to be involved, if what you claim is correct.

you don't talk about a lawyer (a common theme on this site). do you have legal representation? you need someone to step in and step up on your behalf so that this deal doesn't fall apart. if you're in contract, that contract should certainly protect you from them attempting to sell to someone else.

if you don't have a lawyer, go get one, quickly.
