I want to buy a house before I file for divorce. I have great credit. What legal steps do I need to take to do this? I live in Monana.
Not sure I understand the dilemma. What is preventing you from getting financing? Are you in a community property state and your spouses debts are being calculated into your debt ratio? More details would help to better assist you.
Why wouldn't you want to divorce then buy a house is my question. If you purchase the house, make sure you use your credit only to do so, because if you don't then after your divorce your ex-husbands name will be on the deed of trust and on the note. If you are going to buy while married, just run your credit only and apply for the loan in just your name. That way only your name appears on the loan note.
I think you need to discuss this with your lawyer. You could potentially jeopardize the terms of your divorce settlement, assuming there is one.
