My father had been sick for a year or so. He moved out of his house and gave me the keys to house, cars etc. He moved in with his mother which made her the power of attorney. When he died in March, her power of attorney was no more. Now we have to go to probate court in Feb. I have two brothers who want only the money off of the house. The only thing about this my father was the second and I am the third. He had left everything in the third. What do I need to do? Like I said he left his wishes with me. Therefore, giving me the keys to everything.
i think you will have to wait until the house comes out of probate to do anything with the house. what do you plan to do with it? sell or refinance and pay off your brothers?
Hi dro,
I agree with Chris that you will have to wait till the property comes out of probate. Once the probate is completed and you get the property, you can then decide whether you want to sell off the property and give money to your siblings. But if the property was given to you solely (i.e if it's mentioned in the will that you will be getting the property after your father's death), then there is no need to share the property or give money to your brothers.
Thanks
