My friend and his ex-wife built a house together while they were married. There was never a loan. They built as they went. They divorced about 6 years ago and he was awarded the house here in Magnolia, Texas (Montgomery Co.) and she was awarded the overseas property. What can he do to make sure the property is soley in his name so that it does not go to her if something happens? Can he file the papers himself instead of going to the expense of an attorney?
Hi Lisaossey,
Your friend can ask his ex-wife to sign a quit claim deed and transfer the property to him. Once she does so, he would become the owner of the property. He can take the help of an attorney and get the deed drafted from him. Once the deed is filled out, it needs to be notarized and recorded at the county recorder's office. It is better to take the help of an attorney in order to file the deed.
Thanks
