how can I get my deed changed back into my name

Posted on: 09th Sep, 2008 08:04 am
I lived in my home for 10 years. Two years ago a friend moved into my residence. I had a mortgage for $180k in my name only. She offered to give me $90 towards the mortgage in return wanted her name on the deed. I accepted the money and refinanced my mortgage for lower payments. About 2 months later she got a new deed prepared with her name on it and I signed as joint tenants. Since she has left and will not sign my home back to me or accept any settlement I offered. She is trying to force me to sell my home. Can she do that?
Can the deed on a house with a mortgage be changed into someone elses name without the consent of the mortgage holder?

When my father died , my mother received the property including a house she resides in, she was being scared by the credit card creditors in which so had cosigned with me that they were going to come and set her out on the street. My late husband used the cards and went over limit , I was not aware of his doings. She thinks she signed a deed to my sister. Now my sister has passed away and her husband and daughter have the property. My Mom has a life time estate clause , paid all the repairs and upkeep on the house and property for the past 15 yr. but she wants to sign the deed over to me since it was my father's family home and land. My sister and I was only half siblings, Can Mom change the deed ?

Wil some excellent attorney be willing to accept the challenge on the situation above for probono or Mom is wanting to sell , perhaps if you win paid after the selling of the property. An realtor offered 80,000 for the property and house , which I think is extremely low. But my Mother and I need to get back our property , will someone help us

my mothers home is being left to both my twin sister and myself....i owe 300,000 on my home....my sister would like to buy me out of 1/2 interest of my mothers home that would be left to both of us which would enable me to pay off my house and would allow her to eventually have a home with lower property taxes that is now currently worth the same as my home...it benifits her as she is collecting social security and even thought she has 400000.00 cash she could not afford to buy a 600,000 dollar home...our mother is 96 years old and my sister has been living with her for two years rent free as she was going through a messy divorce...we are both trying to figure this out...my taxman is unable to answer my questions...redoing the family trust is easy and my mother would do that...but the money part is confusing....should my sis and i put both our names on my house....and then try to do a trade of interest in each home at the time of my mothers passing....yikes..

you ask your father to sign a quit claim deed in your name

Hi Robert,

You may have guardianship over your father, but I dont think you can transfer any property title in your name without written permission from your father. I think you need to get either a quitclaim or a warranty deed signed by your father to change the title in your name. You should consult an attorney as he is the best person to guide you in this matter.

Hi Kathie,

You can do an agreement with your sister and let her buy you out. Using the money you get from the buy out, you can pay off the existing mortgage on your home. If you are not sure how much money you should get for your share of the property, consult a attorney. He should be able to give you some idea about how much you can expect to get for signing over your part of the property to your sister.

In reguards to my last question my Father is not able to sign do to being disabled. What happens now

Hi Robert,

If you want to get the property title in your name, you will have to get a quit claim deed signed by your father. Since your father is disabled and cannot sign on any deed, it will be a little difficult for you to get the title in your name. Do you have power of attorney (POA)? If you do not have POA, you can consult a lawyer. Once you have the POA, I believe you can get the title changed in your name. Talk to a lawyer to check if it is possible in your situation.

Thanks,

Jerry
