I got 1 home in my divorce; my ex got 1 home. I've been paying mine-he let his go back to the bank with my name still on the loan. I cannot refiance my home because he dented my credit. 3 yrs later...I now have a Tax Lien on my home because he owe's back taxes and his name is still on the deed. HELP. Can a warranty deed remove his name without me refiancing?

I hope there's mortgage on your property. In such a situation, he cannot remove his name from the property with a warranty deed. He will have to use a quitclaim deed. However, if he removes his name from the property deed, you would be responsible for paying off the tax lien in full.

Thanks for the response. It looks like there's no way out of me. How can I have become responsible for his back taxes? AGGHH. So even if I remove his name from the deed I will still be responsible for paying HIS back taxes? Gosh just doesn't seem fair. I assume if I sell the property I will still end up paying. Think hiring an attorney would benefit this situation?

Before your ex removes his name from the property deed, ask him to pay off the tax lien. Once he pays off the tax lien, then you ask him to transfer the property to you with the help of a quitclaim deed. As far as the current mortgage on the property is concerned, if it's not in your name then you'll have to refinance it.
