My mother is ill and her home is in her name as my dad passed away in 1999. In your opinion what is the best way to get the title out of her name. We all 8 of us will split the house evenly and there is a balance of 13k or so. I was going to have the home quick deeded to myselft to avoid probate and everyone is ok with that but I am not sure this is the best way. What is your opinion?

you can transfer the property in your name by asking your mother to quitclaim the property in your name. once she quitclaims the property to you, you will have to notarize it and record it at the county recorder's office. but if the property is quitclaimed to you, then the lender may ask you to refinance the property in your name.
